    We are in the same boat, and I came across this forum via google as well. We are Canadians living in Texas - my husband has a SSN (H1B) and my daughters and I have ITIN's (H4). This is blatant discrimination and is infuriating to me.

    I am happy to join the group to get something done. I will keep my eyes on the board for further action.

    Hi guys,

    This is what my lawyer said.

    If you/spouse have used your EAD or are using your EAD then your "Current Immigration Status" is "Adjustment of Status Pending/Parolee". If not then it is either H1B or H4.

    If you/spouse have actually travlled outside the US and re-entered using the Advanced parole, then your "Manner of Last Entry" is "Parolee". If not then it is what it says on your I-94 (H1B or H4).

    You do **NOT** need the $80 Biometric fee for the Advanced Parole.

    One quick question....if the spouse is on H4, working on EAD and then travels outside and comes back in using her H4....can she then still use her EAD.....??

    That's nothing new that Dems are pro amnesty. I am not arguing against that. Nancy Pelosi already said something in that regard I think. What I refute is the argument portrayed by misinformed members that the shift in power was caused significantly by the anti illegal alien position. It is not true. That's all I am saying.

    Contrary to belief of some members, I am not disappointed with this. I will continue to be your Ombudsman as usual and report everything, probably you will hear more good news for those who believe that amnesty is the way to go. Facts are facts. I am not here to defend any side.

    Couple of days back, I do differed with IV objective to persue only filing of I-485 by Feb 15. Also, one gentleman from this forum asked me to quit IV...

    I am of the opinion that "Difference of opinion" to achieve goal is OK but not to loose UNITY...

    I did not quit IV but today contributed IV because I beleive IV is fighting for Immigration issues/cause..

    Amen...!!

    TOP 5 Excuses

    1) Participating in the rally may jeopardize my position

    Completely baseless. Rally is being organized after due permission from authorities. Further more IV designated volunteers will be there to ensure it's conducted smoothly. We will not be doing anything that provokes Americans like carrying our National Flags or incendiary slogans and dishonoring of American flags as seen during the rallies of 'undocumented aliens'. We will only be carrying IV approved banners which will not contain anything offensive.


    Freedom of Speech/Expression and right to petition are constitutionally guaranteed rights, even to non-citizens. No one can use that against you. No one deport you for participating in a peaceful rally. All of us are highly educated people who don't have a propensity to indulge in violence and/or property damage witnessed during other protests.


    2) Rallies are bad. Bad things may happen at a Rally

    Perception is a result of our experience with so-called 'Rallies' back home and some here that turn violent. The primary reason for such lawlessness being the nature of participants - uneducated and/or unemployed anti-social elements. Also the political nature of such rallies, conducted by the opposition to inconvenience the incumbent government.

    IV rally will be peaceful, as the participants are highly educated, well-employed people with families. Also IV is conducting the rally to petition the government to change rules and not to bring down/change the government.

    If you need a precedent, we have the Flower protests and SJ rally , both conducted peacefully in a professional manner. In fact a cop even expressed admiration for the way IV protesters conducted themselves, orderly and peacefully.


    3) People who do rallies are good-for-nothings who don't have a better thing to do. I might become an object of ridicule if I participate in one and people find about it. People might think I'm crazy.


    Far from truth. Everyone's gainfully employed people just like you. We aren't different from anyone else, except that we have decided to fight for our common cause based on the understanding that strength lies in unity and numbers.

    People ridiculing others is as old human habit as Columbus himself. Many ridiculed Columbus when he set sail for India. If he had backtracked, there wouldn't be America and we wouldn't be here.


    If fighting for what's right is crazy, yes, I'm crazy. If standing upto fight for my career and my family is crazy, yes, I'm crazy. However, only a little more than people who expect to recieve GC in 2 years, without anybody doing anything to change the situation.


    4) There is no reason for the Rally. The situation will remedy itself. In the recent past people have received GC in 2-4 years and so shall I. ( Do-Nothings)


    Harking back to good ol' science textbooks, let me remind you of Newton's First law of motion - 'Every body [ EB immigrants] will continue in a state of rest or uniform motion [ retrogression] unless acted upon by an external force [IV actions] to change it'. Newton understood it centuries ago. We need to understand it now.


    Situation was different in the recent past as thousands were caught hopelessly in BECs. There was no FBI check. No I-140 backlogs. No 485 frontlogs and backlogs. There weren't 300,000 to 500,000 applications pending for AOS.


    5) Rally will not succeed. Even if does succeed, my non-participation will not make a difference.


    Numbers make all the difference, in a democracy. When a politician sees a crowd, the thing that runs foremost in his mind is 'Votes'. More the merrier (the reason why undocumented aliens being 12 million are treated on priority basis compared to less numerical EB migrants).


    When a senator/congressman is faced with a thousand 'Future American Citizens' ( so called 'Americans in Waiting') - he has two choices antagonize by ignoring them or help them achieve their goals. Any sane politician will opt for the latter, when those thousand future votes could mean the difference between re-election vs. defeat.


    That's why it's important to show up in good numbers. If we approach them individually, they may and for all purposes will ignore us. But if we show up in good numbers, we will make them rethink their position and encourage to take more pro-immigrant positions.


    Though, it might seem one or two absentees don't make much of a difference, in real life it does. These ones and twos are the ones that add upto to great numbers. If we miss out on these ones and twos, we might never reach the numbers we intend to. So it's very important for every one of us to participate.

    I dont think this bill has or will have any favorable provisions for us unless a miracle occurs.

    I think the tech companies have cut a deal with the Senators through which they will have access to 115,000 H1Bs and more moving forward inlieu of no increase in EB green cards.
    Well..if thats the case they seem to have gotten a bad deal cause even togh the H1B visas will increase - there is still the $5000 inc in fee with other restrictions on consulting, removal of dual intent plus the Sanders amendment that deals with layoffs - these conditions nullify whatever the inc in numbers is

    The following are your words, aren't they? I am not sure how anyone could read this anything other than a suggestion that people in ROW category are unskilled and a worker from a oversubscribed country is skilled. You may be the most skilled, intelligent and smart person around here but rest of us can at least read and gather what you are trying to say.

    I have nothing against you but I wouldn't want people calling ROW folks unskilled. I know you were talking about EB3 ROW but there are ton of engineers, software designers, and many more who applied in EB3 (some by skill sets, some by force, and some by choice). They are not unskilled people by any stretch of imagination.

    Now thats unfair .... you are just using one part of the quote to distort the entire post ... The discussion and context of that statement was always on categories.... and was using that sentence as an example on categories...
    The assumption was that readers would understand categories over individual qualifications/countries of origin in this context

    If you destroy the context in which a statement is made it makes the entire post "look" bad and is disingenuous

    In this big black hole we are alone, not the govt. nor the lawyers really care for what goes with us. USCIS is just a money making machine for the govt. Rules are made complex and there are several layers of forms. I wonder why a person should go thru 2 stages before filing for I-485. Or why they have 5 different forms filled Labor/I-140/I-485/I-760/I-131 blah blah blah when they could just do it with 1 form like any other country have or may be 2 layers, labor and I-1485. There's no logic of having to file I-140/I-760/I-131. It's all money game...

    AILA does not care about people its an organization to take care of lawyer's interest. When you file every year the lawyer can make money every year. So be rest assured they will make some noises but will not bite USCIS.

    I guess there is very little follow-up on this issue.

    Even I tried to get an SSN for my spouse (H4) and was turned down... I asked the lady on the counter to give me a denial letter and have it with me. Maybe it will be of some use later in this process.

    I think SKIL/CIR etc are all carrots for the "would be" immigrants to slog their ass off - ultimately, American Congress will only do something if
    A. There is enough pressure from Business community to enact a change.
    B. Persistent efforts by organization like Immigration Voice in educating the lawmakers and using lobbyists like QG&A to get our voices heard.

    We have a legitimate cause but we have to use the right "modus operandi". We need each of the members of IV to go back and talk to their HR/Legal/Managers/VPs/CIOs etc to ensure that our voices are heard. Immigration Voice needs corporate backing and you can help here - make your employers aware of Immigration Voice and retrogression. Ask your employers to contact the Congressmen and Senators of your state on your behalf.

    We need a legislative reform and the only way to achieve it is to make your voices heard and your opinion count.

    The USCIS/DOS set quotas for visa numbers because the United States does not want to be overwhelmed with immigrants. And these quotas are spread evenly through all nations and ethnic backgrounds. Considering the populations of the "oversubscribed" nations, this is justified. I can see where the immigrants from these nations feel "discriminated against" in the fact that they receive a smaller percentage (NOT NUMBER) of visas per capita than ROW countries. This does not make the system unfair. And if you think that certain countries get special treatment, think again; there are plenty of people in ROW (like me) who have been waiting for years as well!

    Yeah much of what you said is true, however when you keep harping on the words "equal" and "evenly" You are wrong. Evenly or equally implies each applicant has an equal shot at getting through in a certain period of time. That's my only beef with what you are saying.
    Once again however, let me state to you that the intent of US EB immigration law is not to be fair to you or me, it is to do what is best for the employer's skilled labor shortage.(Except in a few self petition cases recognized as in the national interest.)
