Hello, I really appreciate a lot if anyone here could help me on this..
The company I have been working with an H1B for a years got recently restructured to a new firm and it filed a H1B transfer for me this Feb. The petition got an RFE and the firm made an Appeal, which is now pending. The job looks now rather unsecure and I am not sure if the company will continue sponsoring me for a new H1B if this transfer got denied in the worst case scenario..
So my questions are:
1. Can I file a COS to F-1 while my H1B transfer appeal is still pending?
2. If my H1B transfer appeal got rejected, or I got laid off while it's still pending, after that happened is it still possible and in time to file a COS to F1?
I am really worried about my current situation now, and thank you very much if you could kindly help on it!

i called TSC and after about 10 mins or wait, i was directed to a very nice lady. Who basically told me that they are processing April 30 application adn since mine is august RD, I have about 4 more months before they look at my file. So to answer, they do go by RD and not ND. She also tole me that my name check has been cleared. Its a matter of time now.
I have not seen any updates on my case, since the LUD after FP. I do have a criminal issue, so I anticipate an interview. However, i have forwared all my court docs to them when i applied for 485. some attorneys tell me that interveiw may not even be needed since they have all the court docs. It was for a DWI 8 years ago.

Can we pursue to have an amendment like SKIL bill or something in Economy stimulus bill? The amendment can be relevant to economy stimulus since it will give competitive advantage to america thereby stimulating the economy. (Something like AC21 made into law in 2000 to increase american competitiveness to stimulate economy)
Also, this way, there is a chance that legal immigration issues will be discussed separately from illegal immigration issues.
The economy stimulus bill is being currently discussed in House and soon will be in Senate where lot of amendments will be voted on. The bill seems to have bi-partisan support as well. We can hope this will be one more amendment to the bill!

I had visited US for 6months in 2005 on H1B visa and currently my H1B is expired( Expired in Jun 2007). Now, I am in US on H4 visa. Can anyone please let me know is it possible to renew expired H1B now? If so, what is the procedure for the same?

My wife is going to India and She has to get her H4 stamped again(I am on H1 and received my next 3 year extension and so did my wife).
My parents are also planing to visit me. Should I book my wife's appointment along with my parent's appointment , or should I book 2 different appointments one for my wife and one for both my parents.

Hi Folks,
My friend's 485 is pending with CIS and he is working on EAD. He currently does not hold any other visa. In fact his last H1 expired more than a year ago. We recently tried to renew his EAD online on USCIS website. However, we were stumped by a question which asks the applicant about his/her current immigration status in US. It was a drop down box and had many options like H1, L1 etc, but there was no option for somebody like him whose current status is just "AOS pending".
How do we get around this? Do you think it is best to apply on paper?

I was on l1b visa from Jun 2008 to Jun 2010, then my company filed my h1b change of status, so now technically i am on h1b status , but i sill have l1b stamped on my passport, i am going to India for vacactions, so i will have stamp my h1b visa, now my question is :
1. Can the Visa officer ask why your company moved you from L1b to H1b with COS ?
2. If the officer asks me, do you plan stay in US permanently ?
What should be the correct answers to these questions ?

Typically, visa backlogs are reduced by issuing visas and thus removing people from the demand list. In this case, the movement is due to decreased demand � people with approved petitions on the waiting list simply aren�t applying for visas.

The article says that dates have moved forward because the people whose dates are current, have not applied for their visas
And suppose we could do the same -- if no one applies the gc even once the PD is current, there will be forward movement.... then WHAM! In one go, all could apply
Anyway, just a thought (or you may call pipe dream :) )

My company and lawyer refuse to talk to me or email me back.
I sent my completed package to the lawyer 2 weeks back, and I have not heard back from him.
The initial draft needs to be sent back by the lawyer for signatures and then the file can go out.

My brother is coming to USA on L1 visa.
His wife has a valid H1-B stamped. However, her employer cannot send her to US for the next 6-7 months.
Can she come to US on L2 and then transfer her H1-B if whe finds a job here in US? Or will her H1-B get immidiately cancelled as soon as she enters US on L2?
