hello...
I was on H1.. but i quit my job and i am currently enrolled as a Full time student.
I need to go to Mexico as part of my Study program....
I have received the change of status from USCIS..but i need to get my passport stamped..
I have not been successful in getting an appointment in Canada....
>> Can i go to mexico and get the visa stamped during my stay there..is it risky???
>> i cam here on F1-h1-now back to F1.... do i have to go to my country of origin to get my visa stamped.

I've been visiting forums for the past 2 weeks since my petition at CSC is pending under Premium Processing. I don't think this is accurate especially for I-129 pending at CSC, VSC as I see in the forums that for several people its taking more than 2 months for regular H-1B.
IN my case, I filed under PP at CSC on 25th May. They received via fedex on 27th May, but they issued me a receipt on 6th June only. Going at all the forums, it appears its happening with everyone. Then they issue a RFE on the 14th day of the receipt.

I have a question regarding location change with same employer. I have labor approved on EB2 India with PD 01/2005. I am employed with a big health care firm which has various locations in the region. I'd like to move to another location which is 30 miles away from my present site. I140 is pending with the same employer. I have also posed this question to my lawyer but appreciate greatly if anyone knows answer to this. Will this affect my GC?

I recently got an RFE for my I 485 Application.
Need to prove my non-immigration status from Nov 29 2007 to Nov 24 2008 .
I have I-797 ( H1-B approval ) for the above mentioned period. But My Last Name in the approval has a typo error ( in place of letter A they misstyped U). My Enployer has opened a Service request to correct the Name in H1 B approval. But he is saying that he never got the corrected approval. Time went by and i applied for H1 ext..i got the H1 extension from Nov 25 2008 to Nov 2011.
So My question is
Is it okay to submit all the documention that was sent to USCIS to correct the name along with the I 797,I-94 for the above mentioned period and explain them that we did not recieved the corrected I-797 ? or not
Please suggest me ..

I have 3yrs degree(Microbiology) and one year postgraduation diploma in computer science and 9years of work experience, Can I apply on EB2, some peolple saying at I-140 stage it gets problemetic with your degree, my employer says you can eligible to apply on EB2, Iam in real dilama, can any one please help me... thanks
I tend to think that your I140 in EB2 will be a problem. Specially so if your filing center is Nebraska. They have a reputation to be very very strict. Ask your employer if he has previously approved cases for people with your background.

This is related to the experience letter and PERM.
I have been working with my current employer for last 3 years in software engineering role. Now I'm planning to move to program management role and planning to apply PERM from this new role.
1. To get experience letter for PERM, can I use the experience gained in my current company. What are the chances of AUDIT if I do so?
2. With my previous employer (3 yrs back) I worked in software and consulting role. Does this experience suffice for my PERM in program management role...Is it something the lawyer has to worry and not me..
