And yes, my contribution to IV so far as been $1000 and involvement in other drives. Your question to me regarding my contribution made me squirm a bit since you might have categorized me with many of IV's freeloaders. That's just like Americans asking me all the time "Are you on an H1-B visa and do you work for a bodyshopper". :)

Hi All,
I applied for my daughter's PIO card and sent all the documents as mentioned in the instructions sheet of the embassy website along with the self addressed stamped envelope. I heard from my other friends that even after you send everything in order, the embassy people would call and say that they did not receive the self addressed stamped envelop. It happened to three of my friends. I am the 4th one. They called today to tell that I did not send the envelope.
The funny part that happened with my friends is that, they all sent $20 and the package came in the very envelope they sent in the first place, that the embassy said they didn't receive.
Did anybody of you also had the same kind of experience or similar incident. If so, please do share.
Why are they doing like that? Do they really think we would do like that, trying to save on an self addressed envelope? It really bothered me for the fact that the lady from the consulate was utterly rude when talking. I am amazed how in the world, The Indian Government is still hiring such people? Of more then a billion population, is that the best person the government of India could find for that customer service post? Its a shame and I am ashamed that such dic*heads working and representing India?
Coming back to the issue...she said sternly, send $20.00 or send envelope stamped otherwise the application would not be processed.
Folks, please let me know where I can complain about this careless attitude of this monster woman. What steps can I take to make sure they don't do that again? I live in TN and I can't fly/drive to Washington DC. The questions is not about the money, but the way they are operating without any ethics is deplorable.

that's ok, you are eb2. so no worries, totally understand. no one is asking you to donate, did u get a personal email or phone call from me asking you to donate? You came to this thread, read my post, felt guilty conscious, and thought someone is asking you to donate, and came up with an absurd reason not to contribute. who asked you to contribute in the first place?
History? your I-485 was applied on 2nd July, 2007. Do u know the history of why u'r AOS was not thrown out the window because CIS reversed the visa bulletin? Who cares, as long as you are in the queue and others are paying for your free lunch.

We are USCIS's cash cows we'll have to give them milk until the last drop....It was a well thought provision as they knew they'll earn more money in yearly AP/EAD renewals then they were earning in H1B renewals. You can apply for ITIN even if your spouse is not in US. I have done it ealrier but the only condition is she shouldhave visited US on dependent visa last year for your to claim?

My wife never been to US and I am married for 2 years now. I have been filing my return as Single.
Last week I talked to IRS and they said I can apply for her ITIN without her being present in US. The condition of visiting US applied to other dependents and not for the spouse. She has to sign my tax return though that I have to mail it to her and she will mail it back to me with her signature.

If you file today it will be past october when you have to choose between EB2 and EB3 (I485 stage for EB2) till that time you have both the process going on EB2 and EB3.
If you start EB2 process in October it will take 6 to 9 months to clear labor and I 140..
It is taking average of 1 year for I140. And there is a possibility of PERM audit , which can derail all your plans.

I was wondering if IV core had some time to analyze this bill and summarize it for their members like the previous version of this bill. Would appreciate a quick summary of this bill with Pros/Cons in this bill for our community.
Can somebody pls do this? The main thing that I am wondering is that if you cannot place consultants on client site on H1B then what will happen to them? How will big consulting companies(the likes of Wipro, Satyam) survive?
Any ammendment on this?

department of labor auditing just about every eb2 labor
vermont and california service center giving very difficult rfe's to h-1b's - change of employers and extensions (they are actually denying them to)
Consulates sending complaints to department of labor when h-4 goes for visa stamping and they see primary hasn't received paystubs from entry into usa
companies closing down because fines/penalties from department of labor are too much.
random visits from department of labor and ICE to employee homes
IRS auditing per diems
It really seems that the government is making a concerted effort in giving the employers and employees a very difficult time. Started getting tough in 2004 but have really ramped it up a notch in last nine months.

I had my H1b till Nov 16, 2010 with Company1
Company2 applied for H1b transfer and it was approved as of Nov 08, 2010 ( but we didn't get any notification about it it's approval until few weeks later)
Company1 filed for H1b extension on Nov 10, 2010
I properly resigned Company1 on Nov 30, 2010 and started working with Company2 on Dec 1, 2010
Somehow Company1 didn't terminate my H1b extension and it got approved as of Jan 18, 2011.
1) Which status am I in? What decides my status?
2) Can I continue working for Company2 without any problems? Has this new approval put my transfer in jeopardy?

Everytime you want to switch employers, a whole new H1 must be filed.
People are always under the impression that because they already hold an H1, then it is easy to get "transferred" to another company.
In this case, the only thing you actually "transfer" is ...yourself and nothing else. The only advantage of already having an H1 is that you don't have to worry about the quota anymore, you are exempted from it.
Since you have to file a new case, approval can never be guaranteed and it is therefore always risky to switch employers (as soon as the new H1 is filed), without waiting for approval. Tricky stuff...

This term is frequently used, even by some immigration attorneys. The H1B is not actually "transferred" from one employer to another when an individual changes a job, however. Reading through this, this only says that the status cannot be changed (to a PR). It does not say that the prefiling of of AOS application cannot be done.
I think we should definitely try to work towards this. There was also an article on Immigration daily (http://www.ilw.com/articles/2009,0225-endelman.shtm) which suggests pre filing as a administrative fix that will solve a lot of problems. It argues that "there is nothing in the INA that compels a particular definition or understanding of what "immediate availability" means."
I am definitely in for such a initiative.
