    i sent an email to Senate Lieberman about the gap between the old and new system and h-1b extension:-

    You might be the only Senate who cares legal immigrants and our contribution to US economy and its future. Some immigration attorneys and legal immigrants find out that the current CIR bill draft ends the existing employer-sponsored immigration system well before the inauguration of the merit-based point system. (please refer to Sec. 502 (d) (2) under Title V � Immigration Benefits on page 264 and 265 of bill text (SA 1150). If the CIR bill was signed into law, some departments would take time to establish procedures and it might be YEARS away to get merit-based immigration system ready for accepting applications. But the bill already ends the employer-sponsored system on �the date of the introduction of the [Insert title of Act]�. Can you see the gap between the old and new systems? At the same time, extension of H-1B is not possible if the immigration application filing is less than 365 days under the merit-based system. (please refer to Sec. 419 (d) (1) on page 239). For those who are already at the second 3-year of H-1B, we would face very unfair situation if the CIR bill were enacted as it is now: filing under the employer-sponsored system were invalid but the merit-based point system were not ready to accept any application yet. Previous time elapses until the H-1b couldn�t be extended after the 6th year.

    I suggest to keep the current employer-sponsored immigration system running (accept new employment-based applications and the filing during such period is valid) until the merit-based system is able to process any applications and to reduce the 365 days to 180 days in sec. 419 (d) (1). Without any changes to eliminate the gap between the new and old systems, some of legal immigrants have to leave the current positions and the employers have to deal with unnecessary turnover.

    the keyword is "certain", in skil that "certain" meany MS or PHD, what does this certain mean, it all depends on the definition of certain, it would be nice if the use the same definition of skil (masters and phd)

    Nothing against Logiclife but response doesn't sound right.

    IV is a voluntary organisation. You can request people to volunteer, but cannot force them or scold them for not volunteering. This is not professional. They might have their reasons and the right to work their way. I agree with your frustration when people who signed to turn up do not show up. But I feel this is not the way to express it.

    Thank you for sharing with me your support for comprehensive immigration reform. I appreciate hearing from you and share your concerns.

    While the United States cannot afford to absorb all those who want to settle here, we are a nation of immigrants. My mother came to the United States from Lithuania with her parents when she was two years old, and our family created a new life in Illinois. It is a testament to the greatness of this nation that the son of an immigrant can rise to represent the state of Illinois in the Senate.

    At the same time, our nation faces a host of problems as a result of years of inattention to our immigration policies. The Homeland Security Department estimates that about 11 million people in the United States do not have legal status, including those who enter the country illegally and those who overstay a temporary visa. I have worked to reform our immigration system comprehensively and in a way that is tough, realistic, and consistent with our moral values.

    While there currently is no comprehensive immigration reform bill in the Senate, I recently joined a number of Senators in releasing a blueprint outlining the basic principles that a reform measure should include. The plan would improve border security by increasing manpower and deploying new technology. It would strengthen enforcement against employers who hire illegal immigrants. Today, undocumented workers are often exploited by employers who hire them. Strengthening the penalties for employers who hire undocumented workers will ensure that both immigrants and citizens who work here are protected by our wage and labor laws.

    If we are serious about reform, we need a realistic approach to the millions of undocumented immigrants who already live and work in our country. We need to offer immigrants who work hard and demonstrate a long-term commitment to be law-abiding, contributing members of our society a chance to pay fines and earn their way to permanent legal status over the course of many years.

    If we do not give people who are already a part of our communities the chance to earn their way to legal status, we will not solve the problem of illegal immigration. People who are living here illegally will stay in the shadows instead of coming forward to register with the government.

    Immigration is good for America, but an employer's first job offer should go to any American who is willing and able to fill the job. I have been concerned about the potential impact of past proposals for temporary guest worker programs on the American workforce. In many industries, the assured availability of large pools of guest workers will give employers an incentive to pass over American job applicants in favor of foreigners willing to work for less pay and fewer benefits. During the immigration debate, I offered a Hire Americans First amendment to require employers to seek American workers for their open positions before they try to bring in guest workers. I have also introduced legislation to combat abuses in the H-1B visa program.

    There is no perfect solution to the problems we face as a result of our broken immigration system. Today, our borders are not secure, our workplace enforcement laws need reform, and our immigration policy fosters a shadow economy for millions of immigrants who simply want to demonstrate that they can be hardworking contributors to the greatness of our country.

    I will continue to work for a package of reforms that will protect American workers and that will be tough, enforceable, economically sensible, and morally defensible. I will keep your views in mind as the debate continues. Thank you again for contacting me. Please feel free to keep in touch.

    factoryman, looks like chlei or whatever has wrong information. i guess he/she is presuming "Schedule A applicants are entitled to up to 50,000 �recaptured� numbers." even now.
    chlei or whatever, that is not true. those 50000 expired jan 2007 or sometime around and i agree with factoryman that we must stop them from geting our unused visas again this year. i have written to some senators listed on HLG blog

    This is a different employer, so I am assuming it is new H1. If I remember correctly from my past research, H1 is always NEW when you file it with different employer, but I am not 100% sure....

    It is just semantics

    It is New H1 with Transfer of I-94. It has been shortened into H1 Transfer to separate it from 65000 per year Quota.
    If someone gets the H1 approval without I-94 they call it H1 is approved but transfer denied. They will have go out of the country and come back to get I-94.

    When someone doing the Transfer they put it as new H1. Then they will say whether it is coming from yearly quota or not.

    You can sign on on behalf of your son and you can place (father/mother) next to it.. This won't need a G28 form.

    I am preparing I131 (AP) renewal application for me and my family. For my son, who is 8 years old, do I need to fill "Part 9. Signature of Person preparing the form, if other than the applicant" since I am preparing this form? OR can I just sign Part 8 on-behalf of my son?

    G-28 form says it needs to be filled in case if you use Attorney or Representative. Just wondering whether I need to fill a G-28 form for the above AP renewal application for my son since I am filling Part 9 in his application.

    Can somebody clarify? Thanks for your help.

    I second you on that.But we must keep in mind,we know the law before coming here .Every immigration lawyer wants H4 law to be changed but, you know "USCIS".. they have handsfulll.

    But even knowing what H4 entails is not so much helpful. Only when you experience it on your own, you realize what a bad move that was.

    E.G. If I knew the time in H1/H4 is counted together I would not have accepted moving every 3-6 months with my husband on his projects. I would have done everything to get my H1 in my first year here and my husband would stay and change H1 sponsors every year if need be.
    But no, it had to go other way.

    Several imm lawyers misguided me in this H1/H4 time matte, until it was literally too late. Hiring time in my profession is tied to the beginning of the school year when all H1 visas are long long gone.

    I was getting offers when I cannot get a visa and vice versa. Not a single school district wants to tend an offer 9-12 months in advance...
    And - well, you all now how the story goes from there. We cannot buy a house, we cannot start our business, .....I guess we are just fed up with 'no - you can't do that' answer, every time we want to do something with our lives.

    This 'on hold' situation lasts too long.
    I am only staying here to further my professional education and benefit as much as I can, so that in the end the trade off is not going to be so bad..

    7 years ago, when my hubby and I had enough of civil war in our home country, we were almost ready to send our papers under SW category and move to Canada.
    As luck would have it, his H1 went through faster then we imagined, so we ended up in the US. I wish we had a foresight to go ahead with Canadian PR as soon as we came here. We would have been both much better off, already citizens, profesionally more satisfied and happy.

    desi9333 thanks for the link. Nice one - even though it covers only Hiring practices, and not opportunities for promotions and progression.

    The "Opportunity" usage has been explained much beyond Hiring in the other laws and related documents. Hence, an employee who subsequently faces discrimination because he/she cannot progress or misses on job advancements due to Visa limit restrictions is certainly being discriminated against.

    Its my view and others can differ. I respect all opinions and am thankful to all because it helps improve my reasoning, mutual respect and tolerance abilities.

    Back to the subject,
    My earlier post on first page this thread has some action items - can anyone here take the lead and convince an attorney to take up the cause?
    My cheque shall be sent as soon as the ball gets rolling.

    The aim is not to convince an attorney. You can file a lawsuit for any reason and fight it. But the question is - Is the case strong enough?

    In this case the case is not strong. IV has access to best attorneys and we have had discussions on this as well. The best way to change country limits discrimination is by changing the law.

    Good morning,

    If you pay a closer attention, I don't start threads. I just reply to messages following that topics you started. The real issue is that many members in this forum are so biased that you cannot take a different view.

    For example, yesterday many in this noble forum became so uneasy and angry as soon as I mentioned that shift from democrats to republicans was triggered solely by the disatisfaction with the Iraq war. It turned out that Bil O'Reilly last night said the same thing. That is based on facts, because exit survey according to O'Reilly, did not indicate that people voted against Republicans due to other issues such as immigration. Then I went on and even showed articles from liberal newspapers such as The Nation to confirm my sources. CNN published e-mails from several voters on why they voted against republicans and immigration was not even mentioned in that sample. If you do not want to believe that and prefer to follow other views, that is fine. My point is, I won't get mad with you. I won't request that administrators shut you down. You have the option to do so. However, saying that my analysis is off base and I bring here unrelated topcis is not true. There are reputable people out there who agree with me. Grow up and learn how to deal with the reality.

    What amazes me is that those are not fundamental issues for you to discuss and get so mad about. Who cares now on why people voted republicans out? For you and me it matters that we take you greencard and move on. I feel that it is my way to contribute when I admonish you about distorted views. Bringing that level of critical thinking may strength your maturity and knowledge and that can certainly increase your skills in the fight for immigration relief for the employment based immigrants.

    I have mailed 17 more individual signed letters to WH address this afternoon and copy of these 17 signed letters in one envelope to IV address. Good to see new date. I will continue to get as many as I can before this new date.

    Collected 11 signatures during NJ trip and I guess these will go into NJ account..and 6 signatures from FL [11(NJ)+07(FL)=17]

    Hi Mirage;

    What is the new expdate on your new card (if you already have it in your hand)? dose the 1 year ext is from the last date of your current/old card? or 1 year from the date the new card was approved.

    My AP was from last expiry date.. Not from the day it was approved. Its the same case with EAD also...

    Why is the December visa bulletin not available on the USCIS website ?? It still shows November as the current bulletin.
