Something can happen if we have a Democrat Congress which is filibuster-proof, meaning > 60% of total membership must be Democrats, AND a Democrat President, then something good could happen for us. It might not be exactly what we like because "undocumented" will get the same as well, but atleast also get what we want.
Nothing good will happen for us if we have a Republican Congress and Republican President. They will just make life hard for all of us --legal or undocumented alike. If we are having a hard-time getting a Driver's License right now, then expect worse if this combination happens next year plus the continuing recession.

I had a 2004 PD Labor RIR and my 2006 I-140 used that labor date, because I merely mentioned to an IO at TSC that I had a previously filed labor. My lawyer was shocked when it happened...had never seen it.
So, I wonder if they used your 2004 RIR as your PD. Even then EB 2 is supposed to be unavailable. Oh well, it might help to speak to an IO to get your I-140 PD changed...maybe...

My wife moved from H4 to H1 in June 2007 and obtained her SSN at the same time. We used her new SSN to file our returns in March this year. However, no sign of the stimulus package yet. Wonder how is our case being considered. Thoughts?

So if this bill is introduced as a new one with a new bill number, does that May 15th provision still stand? Or is it now gonna be June 19th ?
Section 501 (Rebalancing visa numbers and Z visa allocation) is effective on the first day of the fiscal year subsequent to the fiscal year this bill is enacted.
Here the fiscal Year is from 1st October to 30th September. If this bill is done within next couple of months, we are talking about 1st October 2007. This is my interpretation.
Section 502 (Merit based system) is effective from first day of next fiscal year after this bill is enacted, provided it is ateast 270 days away. So I am guessing, we would not see Merit based point system till 1st October 2008.

my app reached USCIS on July 2nd. I called up USCIS, the lady read the July Bulletin update word by word and then told me that my application will be rejected and the original documents will be sent back. She did not have an answer on how soon this will happen.

The new visa regime -- 'Direct Airside Transit Visa (DATV)' -- would come into effect from midnight tonight, it said in a news release. The other countries affected by DATV are Bangladesh, Angola, Cameroon and Lebanon.
Previously, nationals of these countries needed the visas to visit the UK, but could do without one if they were passing through, within 24 hours.
The Home Office cited six reasons as to why the measure was being introduced saying "there is a significant level of abuse of the UK immigration control committed by Indian nationals".
Home Office Minister Beverley Hughes said, "We are responding to intelligence that a growing number of nationals from these countries are using the transit route to flout our immigration controls and to enter the UK illegally or to make unfounded asylum applications."
He said the announcement was part of a package of measures being used to strengthen UK border controls abroad, including new screening technology and better use of intelligence to break up gangs that profit from the trade in illegal immigrants.
He also said that the UK is committed to a continued increase in the number of visitors and students from India.
"We can ensure that those who do not qualify under these waivers and who need to apply for a DATV can do so as smoothly as possible and at any of our 11 visa application collection offices across India at a cost of Rs 2,150," he said.
On why Indian nationals would need DATV, the release attributed it to the significant level of abuse of the UK immigration control by them.
It said between January to June this year there was evidence to indicate that Indian nationals accounted for 40 per cent of the cases where passengers able to transit the UK without a visa and who then sought to stay here illegally or by making an asylum claim involved Indian nationals.
Last year, around 2000 Indian nationals applied for asylum in the UK and indications were that the number this year would be even higher.
Further, during the same period some 400 arrived without any documents and more than 270 using forged documents.
Indian nationals account for the highest number of asylum applications made on arrival in the UK, it said adding that this was part of a general tightening of controls to prevent abuse of the asylum system.
Its funny how some so called indian "newspapers" like siliconIndia are very religious to echo the "statements" and "Sentiments" of these people from other countries. Again, this article states "it is said...bla bla", they are talking as though it has become an epidemic and all the billion plus people from India are gonna follow to their greener pastures. The total number of applicants from other countries can be derived from roughly estimating number if H1 holders, adjusting for Indians and Chinese, and then dividing by 2 (50% of H1Bs never end up getting a green card), and then multiplying by 2 to adjust for derivatives. The bottom line - there are visas available in EB2 ROW and EB1 categories (which are current, meaning, undersubscribed), that are getting redistributed to EB3 ROW. This is why EB3 in total is using more than its share of 140,000 EBs. In fact, I believe the dates will be moving pretty fast on EB3 ROW, it will probably get all current in a couple of years.

u cannot roll into a roth directly. u have to roll into a regular ira and then to a roth.
but the earlier statement made sense.. dont withdraw immidiately..wait till the next yr and then withdraw from ira..so ur taxes will be 10% penalty and ur tax rate at that time...which will depend on the value of ur 401k.
so if make 80k now and are in the 25% bracket and u have 80k in 401k then u ll have to pay taxes equivalent to the 25% bracket.
but if u make 80k and have 20k in 401k then u r bracket will be the lowest one.

I agree with you 100%. As this is true, lawmakers are very well aware of our grief, but none of them is saying it. They want to oppose legals in the name of opposing illegal immigration bills. If you look at CIR in 2006. First they put legals in the bill with illegals, then they oppose illegals, ultimately the result is no legal immigartion too. Nothing is getting passed in the congress for the legal immigration. what does it tell ?

This post does clarify visa recapture issues, but what about concurrent 140/485 filing ? Also, if our fate is still so tied up with 12+ millions illegals, doesn't that mean that we failed to make our case, even with so much media coverage, lobbying and our personal efforts to call the law makers. Could another explanation be that lawmakers have all but refised to treat us with dignity we deserved as an educated, law abiding, tax paying citizens contributing to the society. I believe that we didn't fail and we tried what we could but still lawmakers refuse to act on our casue, may be they are implying something without explicitly saying it ?

A lawsuit against USCIS for $20, thats cheap, I am in. BRC screwed me twice, when both labors went to BRC with no outcome then I filed third in PERM and thatwhy I am stuck with 2005 Sep PD with folks who just came to US in last 12 months and filing for 485 now. I know most of BRC folks are still stuck there and I am with them, lets get this cleared and have celebrations with all of us.
