    Guys,
    Firstly thanks for the great show at DC, we are really beginning to bring this issue to the fore front. I could not attend myself but I did make a small contribution as a token of my support. However we should capitalize on the momentum and follow this up with some thing more substantial so that every one knows that this was not a one off spark but is a clear growing fire.

    I guess (just by reading posts on IV) one point which came out pretty clearly was that IV has good support in some regions and really very little support in some others (support as in visible support, where people are willing to show up for rallies, contribute to IV�s efforts etc), I guess this pretty much means that we need to focus on building the regional chapters of IV, like have strong/formal leadership and goals of each of the chapters.

    I was also thinking that we can possibly learn a lot from the protests by undocumented immigrants. They had record turnouts in their rallies and most of their people stayed away from work to take part in the efforts when ever there was a call for the same.

    I thought which keeps hitting me is about a simultaneous rally in all major US cities? I know that undocumented immigrants did this and that really worked for them and once again this will build our regional chapters coz the onus will clearly be on each of the regional chapters to achieve targets (target in terms of membership, turnout in rallies, fund raisings etc ) set by IV

    Some of the advantages of having simultaneous local rallies is that
    1) No travel expenses � (So that we can spend more money on media and lobbying than travel expenses)
    2) No need to time spent on travel � ( Better turnouts)
    3) Comfort � every one can just go to a local rally point (Better turnouts)
    4) Stronger regional chapters � (work at grass root levels)

    Also if this can be done on a Saturday then I am sure the turn out will be much better.

    I am a master's from US in STEM too with more than three years oof experience but I am not thinking like you.

    Reallocation of Immigrant Visa Numbers

    Immigrant visa quotas would be substantially realigned under S. 1348. Our current law provides for a baseline annual quota of 140,000 immigrant visas for foreign nationals immigrating on the basis of employment. In the past several years, a backlog has developed in several employment-based immigrant categories, with multiyear waits for some prospective immigrant workers. The Senate bill would, in the first five years after enactment, increase the quota for merit-based and employment-based cases, in part to address existing backlogs. An estimated 247,000 numbers would be available for work-related immigration. Beginning in the sixth fiscal year after enactment, however, the quota would drop to 140,000 numbers per year. This level would remain in place for at least two years, until approximately the eighth year after enactment, when the quota would rise to a baseline of 380,000 per year, with additional numbers made available for previously undocumented immigrants who become eligible to apply for permanent residence.

    The bill would also realign quotas for family-sponsored immigrants. Visa quotas for family-based immigration are currently set at a baseline of 480,000 per year and are subject to very lengthy backlogs, ranging from five to upwards of 20 years for some family categories. The Senate bill would initially increase visa numbers by more than 100,000 per year in order to reduce the family backlog; however, after the conclusion of backlog reduction efforts, the family-based quota would fall to 127,000 per year.

    I receive the standard IRS letter regarding stimulus rebate.
    I took this letter and went to SSA office to apply for a SSN for my wife.
    Point number 3 in ss-5 clearly says .....

    "If you check "Legal Alien Not Allowed to Work," you must provide a document from a U.S. Federal, State, or local government agency that explains why you need a Social Security number and that you meet all of the requirements for the U.S. government benefit. NOTE: Not all U.S. State or local benefits are acceptable for non-work SSN purposes. Contact SSA to see if your reason qualifies.
    If you check "Other," you must provide a document from the U.S. government agency that explains why you need a Social Security number and that you meet all of the requirements for a Federal benefit except for the number."

    I believe that IRS letter should be treated as a sufficient reason for need of SSN. BUT THEY DIDN'T ENTERTAIN ANY OF THE FACTS AND DECLINED TO ACCEPT APPLICATION FOR SSN.





    As long as you qualify for the stimulus payment, you can get a non-work SSN. You qualify as long as you are in the income levels specified, were a resident of the US in 2007 (substantial presence), and were in the US legally (have a valid visa). If you did not file a tax return, then you cannot apply for the SSN.

    As far as the Social Security Act is concerned, the law states that they MUST give you a SSN if you qualify for any federally funded benefit. The question is: Is the Economic Stimulus Payment a federal funded benefit. The information in my original post makes a very strong case that it is.

    Please post your experiences here, even if you are denied. Remember, the folks in the local SSA offices are bureaucrats, not lawyers, or judges, so don't expect much cooperation. However, if they deny you application, simply write them a short letter saying that you disagree and that you are requesting a "reconsideration."

    I have really had good experiences when i renewed my passport, my wifes passport and also when i applied for my childrens PIO card. On each ocassion the documents arrived before time and the service at the SFO consulate was great when i called them with a concern. On all 4 ocassions i use the $20 option to get the document by Fedex. We spend thousands on the recurring nightmare at USCIS, $20 for peace of mind is not a big deal.

    I have also observed that we tend to get overly agressive when we talk to indian govt officials here. I think we expect bad service and we mentally prepare ourselves to fight. I am not saying that all do this but some of my friends did concur with the thought. There are many geuine cases where there is a problem, as some desi govt officers are sticklers for making sure that forms are in 'order'.:D

    While we are at discussing participation, a question I heard at DC comes to my mind. A member ( anil_sap?) asked another Texan member ( forgot name) - 'What takes you to become an Active member?'. To which my friend answered - 'Isn't he active alredy. He is here'.

    That made me think - is being active a nebulous concept. Who's is the real active member of IV? The Core and near-core that strategize, plan , co-ordinate and conduct the business? The guys subscribed to monthly payment but missed DC? Guys who were at DC but not monthly contributors? Guys who were there all 4 days? Guys who visited for a day? "Lunch-Break" agitators? Who is 'active' among these will depend on whom you ask!

    The following portion is in humor. Don't take it in bad spirit.

    I did a self-evaluation, and guess-what, I realized I was a different breed. A 'Know-Nothing' IV member!

    Being a IV member

    1) Do I know why was such a mass mobilization done on that particular day? Is it because there was a push for STRIVE act as speculated in the forums here? Or is it SKIL we are pushing?

    Ans - I KNOW NOTHING

    2) What is the criteria for getting selected for Lawmaker meetings? Why weren't some selected after following the USCIS-inspired process? ( inspired by Marks skit)

    Step 1 : Submit Labor petition E-IV-LOBBYDAY ( twice)
    Step 2 : Verification by Labor department (or is it Name check)
    Step 3 : Receipt Notice ( Talking Points)
    Step 4 : Waiting...
    Step 5 : Followup with RO (Rally Officer). You are still under Processing Time
    Step 6 : Waiting...
    Step 7 : More followup..
    Step 8 : Retrogression due to insufficient (visa) numbers

    Ans - I KNOW NOTHING

    3) Didn't some members from my state attend Lawmakers meetings? What was the result? Where they positive or negative about our cause? What should we do to followup with them?

    Ans - I KNOW NOTHING


    4) What does it takes to become an 'Active' member as defined by Anil? What will take for IV to trust a member enough to let him know of the purported plan for World-Domination? Or should we just remain content gossiping (with near-core members) and making our own guesses?

    Ans - I KNOW NOTHING

    5) Does my State chapter even exist as of today? Or is it an IV version of Flying Sphaggeti Monster, that we should worship without questioning?

    Ans - I KNOW NOTHING

    With so many 'KNOW NOTHINGS' to my credit, I feel like the member of a secret American political party in the time of the Whigs.

    No one will be on our side other than ourselves. Why should others(US business, political, people) should be behind our goals. They do not have much to gain from it. Our voice will be heard, but will not be considered unless the so called others have some facts and figures. Those facts and figures should make them feel that their counrty would lose to competetors in near future. It will take time.

    Get support from whom? The same corporations that want to outsource jobs to low cost countries AND also lobby for H1B increase, again to keep wages low and all this to increase their bottom line. We need to re think our strategy and get it straight as to who is on our side and who is not.

    Just to clarify. You say that "a person with an MBA plus a 4 year bachelors from a US univ. will be exempt" but you don't really need the 4 year bachelors from a US university. The MBA from a U.S. university is enough to be exempt, even if your bachelor degree is from outside the U.S.

    You are right. I typed it wrong. I really meant to say "4 years of bachelors from anywhere (which is equivalent to a US bachelors degree)". I was making the point about four years because some non-us bachelors degrees are 3 years, and they do not accept 3 years + masters as equivalent to US bachelors + masters as the number of years of schooling would be one year less.

    I would love to attend the rally. However my financial condition at this time does not permit me. I could have booked a ticket on my credit card but all my cards are max out!
    You want to know why I am in this financial deep hole? Well, I have two sons in college and paying out of state tuition, that is over $17,000 per semester for both of them.
    My wife on H4 could not work until now that she has an EAD. It is retrogression that I should blame and I would love to do all in my power to obtain relief or bring the issue to the attention of the American public.
    In my own way I have contributed to IV both in cash and in kind. I have told me story in countless media interviews. I only wish I could do more for IV financially but alas I am not able to do that at this time.
    I would be in the rally in spirit....only I wish I could attend in person.

    We can help! We want to make sure as many people as possible come to the rally. Those in worse financial positions can take advantage of the many generous offers from other members who are willing to sponsor others.

    Hi Nat,
    Fragomen took about 6 months in getting "prevailing wage info" for my case in 2001. My manager ( Canadian who had gone through US GC process himself) finally talked to them and asked them to file without waiting for DOL's reply on prevailing wage. (That was a risk but we agreed to take it at that point)

    That six months delay costed me 6 years in GC processing ! But thanks to my manager , otherwise I dont know how many more years I would have waited.(One of my co-worker still awaits his labor cert !)

    The big law firm goes by predefined steps , which are probably the safest way for most cases but may not be the fastest way. You need somebody who has been through this process and can understand and asks good questions to lawyers and can help lawyers to think for your perticular case. Check if you have somebody in your org to do that.

    My company started the PERM process for me about 2.5 months ago. I contacted Fragomen about 1.5 months after approvals within the company and they said they are working on establishing min requirements for the position. I then contacted them 3 weeks after that day and they said they have established the requirement and will request the DOL for prevailing wage info (this was 2 weeks ago). After which they are going to start the recruitment process. So I'm not sure if the time line is okay or should I be chasing them more frequently? Please advise.

    Every time it hit Nov 2001, the dates were made unavailable and the cycle started again from early 2001.
    I wonder what is going to happen next month??

    This time it will be different since we already crossed April 2001 which is a significant date in terms of 245(I) cases.

    Mundana.. I'm not trying to discourage anyone, by all means people should seriously try it and see.. instead of the endless talk..
    You'd certainly find the poetic notion in the constitution that "all men are created equal" but if the purpose of the US government and its agencies didn't allow them to balance this with protecting the interests of the US public, a billion people from around the world would move in tomorrow. By your logic, an illegal or one with visitor visa would apply to a job he's qualified to here then sue USCIS because their stupid rules that do do not treat him equally like all other men cost him the job.. Congress enacted the INA (Immigration and Naturalization Act) and tasked USCIS to enforce it.. I researched Title VII and the INA in my paper (so much fine print than the highlights u mentioned) and can tell you that title VII specifically allows INA to override it in matters relating to Immigration, and in many cases INA obliges and in many cases walks all over the EEO and all men equal concepts.. as i discussed with my employment law professor who had a good background in immigration, the situation can't be changed without rewriting Title VII and the INA..
    Anyway, just my professor's opinion and mine, u have every right to disagree but plz let's do something instead of talking..



    Here is the history of derivative acts under 14th amendment related to employement:

    14th Amendment of the United States Constitution: guarantees due process and equal protection under the laws.

    The Civil Rights Act of 1866, Section 1981: covers race-based discrimination by employers. Individuals may sue to assert their rights under this Act; which, unlike Title VII, has no limitation on back-pay liability.

    The Civil rights Act of 1871, Section 1983: provides persons who believe they have been

    ...
    ...
    ...
    I therefore believe there is a good chance at the Supreme Court ruling that because of long wait times of more than 3 years for a Green Card plus requirement of same or similar job during that long wait until the green card is received plus country quota affecting people born only in few countries leads to disadvantage for people of these few countries at work.

    And yes, even I took law course and gave a seminar during my MBA. But even you would concur that this course at best is basic and does not make a person authority of the US legal system.

    Finally, forget me or you, even a lawyer cannot say for sure what the final ruling will be in any case. And hence the best a person can do is give an educated opinion. In addition by human nature, the way I would interpret laws would be to my advantage while the way you would interpret them would be to your advantage. And hence I can understand your biases (and mine as well) because in case the country quota is found illegal by the US Supreme Court, it is the ROW that is going to be affected the most.
