Hi - I am currently on an L1 blanket visa and it looks like my company will sell the unit I work for in the US. The parent company will sell the US division - I am currently in the process of applying for my GC - with the I40, and I485 both pending. I had my biometrics done today.
Want to gain some views on what my options are if the GC route does not pan out. I am on a UK passport, and would like to remain in the states. The GC is an employment based application - which is apparently quick, but I want to have a plan B. Is the next best option the H1B, and if so, will I be able to apply for this (if needs be) inside the US with another company if they are prepared to take me on?

It depends upon your luck with AP. Because you never know when they will be approving your AP and in case it is lost in Mail (it happens to lot of people) and you need to re-apply with fees again. This is very tricky....... You may get it in few weeks or few months or never. Not to discourage you, it really how lucky you are. All the best. I always will file 3-4 months in advance.

Hi all.
Does anyone know if one can import a Poser file into Swift 3D, animate it, and export it as a vector-animated movie to Flash 5? It would be nice to see Poser characters move well in Flash without having to rely solely on Flash.

What are the options when labor is being audited?
- Know the reason for audit
- Start a new process and make sure all the reasons from audit are covered under the new process
- When ready to file PERM, withdraw the old application and file a new PERM case
If you are not audited again, you will get the approval in less than 2 months.

Thanks for reply.
Another thing I would like to mention. My I-140 got approved couple months back but applied I-485 during July 2007, so it's more then 180 days for I-485 not for I-140.
Any suggestion.

I applied for H1 on Oct 10 2010. I got an RFE - (relatively benign - proof of labor cert filing) on Feb 22. My attorney responded and they changed the status to RFE Response Review on March 3rd. Unfortunately, I'm planning to go to India on the 26th.
- Would upgrading to Premium help at this time?
- What is the typical response time between RFE response review and decision?
btw, this application was processed in the Vermont Service Center.
Any help would be greatly appreciated. Thanks in advance.

I need feedback from you guys. I have researched this lawyer before I got her to start my greencard and the feedbacks seems that she is efficient and knowledgeable. However, since we signed the contract with her, things have been moving so slow. She doesn't want to talk to me or give me status updates when asked. She has all the information needed from me and my employer to start the prevailing wage request but a month has passes and nothing has been requested yet. Has anybody here experience the same thing?

The big news is that the masters cap was hit as of December 24th. I had been predicting since last summer that this 20,000 quota would be hit in the last week of the year and the pace of usage stayed extremely consistent. The general quota has 7,700 visas of 65,000 remaining as of December 31st and the rolling four week average is now running at just over 1500. YES, (1) in the same line of specialty area (2) and full time & part time employer should permit taking up another job (ie. some employers ask you to sign a agreement not to work for another employer during the employment with them)

Hi I am going to india on july and I need to get my h1 visa stamped as the previous one expired and at the same time my wife needs to get her h4 visa stamped
now when i return back i am planning to bring my parents on short trip
my question
1.Is it possible to book appoinments for h1,h4,b1 at one shot (one day)
2. Will there be any issue if we go in group in combination of many visa
requesting your valuable inputs

Your help on the matter is appreciated. I am EB3-I. I filed for I-485 in July-07. I have been working on H1. Now I am going to switch to EAD by AC21. My new job has same job title and job duties. They have another condition for job. I will have to have a Masters in 8 years of starting my job.Their basic requirement is still Bachelors but Masters condition is kind of extra condition. My question is does this give me any trouble for my GC process because of Masters condition.Another question is will I be able to switch to EB2 based on this.

Hi,
I'm on H1 on 8th Year Extension,Got a nice offer from a company, which is not large company, but projects they have are very long term projects I applied for 485 long timeback, but did not applied for my spouse , who is on H4 , applied for H1 which will be validated from 1st Oct'06.Can I switch the company now and start using EAD and apply for my spouse when my PD becomes current , or wait with the current employer till I apply for 485.
Need SUggestion.

My grand father and grand mother are trying to apply for visitor visa.. my grand father is a retired govt employee and grand mom is home maker.. my grandfather is coming on their own and we are not sponsoring them..he will be able to submit tax returns as he runs small business and owns 1 apartment and few lands my questions are:
1.what are the documents should he take for visa ?
2.how much of bank balance? (they say 6 months of bank statements is necessary)
3.cant he just say he's retired and take the asset evaluation and bank statements alone?
please help ...

I am planning to get religiously married by end of next year, 2009. But I am considering doing a quick court marriage in the next week since my dates are current. I have a couple questions regarding time frame:
1. If I do get my GC soon, then I need to apply for following-to-join. Is there a time limit for this? Can I do it as late as I want, as long as the spouse doesnt come to US before?
2. If I do not get GC for a while, is there a time frame after marriage before which I have to apply for my spouse's 485 as a dependent? Does she also need to be on H4 and in US before applying for 485?
Thanks a lot for all the help. I am relatively clueless about this marriage related GC business.
